Abducted Witness Shukho Ranjan Bali is victim and eye witness to the atrocities committed in 1971. He saw his Brother Bisha Bali’s murder and arson which destroyed their village. He was abducted from the Tribunal Premises by Plain Clothed security personnel

As 72 hours have passed since abduction of Witness Shukho Ranjan Bali, chances are fading with the wastage of time. The Government is doing everything but to look for him. Instead, they are hindering attempts of his trace him:

Police denies registering Complaint

Senior Defence Counsel Mr Mizanul Islam who was bringing the witness Shukho Ranjan Bali in his private car tried to file an official complaint (known as ‘General Diary’ or G.D) with the concerned Shahbagh Police Station on the evening of the incident (5th November 2012), but the police refused to accept the GD . Police also refused to give any explanation or reason why they are refusing to do register which they are legally obliged to do. Such unreasonable and unlawful refusal of Police speaks volumes about their alleged involvement in the abduction.

Supreme Court Hearing postponed by Attorney General

An urgent application before the High Court Division of the Supreme Court of Bangladesh was filed seeking direction upon the Government to produce abducted witness Shukho Ranjan Bali (Writ of Heabious Corpus under Article 102(2)(b)(i) of the Constitution of Bangladesh) on 6th November 2012 and due to urgency of the matter, the Court was pleased to fix the hearing date on 7th November 2012. However, on 7th November 2012, the Deputy Attorney General appeared before the court and informed that the Attorney General himself will appear on behalf of the Government and he cannot come to court due to his personal difficulties. The Court most reluctantly had to postpone since such prayer for adjournment by the Attorney General, the highest officer of the Court had to honored, and fixed 11.11.2012 for hearing. The Government and attorney general abused the custom of the court and delayed the hearing putting abducted witness Shukho Ranjan Bali’s life further into danger.

Prosecution alleges ‘False Propaganda’.

Today on 8th November 2012, the Chief Prosecutor in a Press Conference alleged ‘False Propaganda’ on the part of the Defence and claimed that the witness is hiding due to defence teams intimidation. He further claimed that the daughter of the abducted witness Shukho Ranjan Bali filed a General Diary with Police that he is being intimidated by the defendant’s people.

However, most alarming things is that the Prosecutor is trying to brush off the abduction incident by referring to a General Diary (Being GD No. 773 filed on 25.02.2012 in the ‘Undur Kani Police Station’ Source: Deposition of the Investigation Officer on  5.8.2012) which was filed by the daughter of the abducted witness almost 10 months ago. Prosecutor did not clarify why the GD was file by the daughter and not by himself. The Prosecutor today could not give any update about the present whereabouts and well being of the abducted witness Mr Bali.

The Tribunal and the Bangladesh Government Continues to ignore the testimony of the 4 eye witnesses being Senior Defence Counsel Mr Mizanul Islam, Senior Defence Counsel Mr Manjul Ansari, Defence Counsel Mr Hasanul Banna Shohag the driver of the vehicle Mr Uzzal. No one tried to investigate or interrogate the on duty police personnel who observed silently as the witness was being abducted. No attempts are being made by Police or any other security agency to find the abducted witness. Rather Attorney General postpones hearing, Police refuses to register complaint and Prosecutors tries to blame it on the ‘Defence Counsels’.

With each hours passing by….. the chance of finding abducted witness Shukho Ranjan Bali alive fades away…. there must be URGENT effort to save the life of the abducted witness Shukho Ranjan Bali
