Moudud Ahmed, Senior Advocate of Supreme Court of Bangladesh and former Minister for Law and Parliamentary Affairs appeared on 23rd December 2012 as counsel for placing the Legal Arguments for the Defence Application for Re-Trial on behalf of the Defendants Mr Delwar Hossain Saydee, Prof Ghulam Azam and Mowlana Motiur Rahman Nizami. Following are summary of his submissions before the International Crimes Tribunal No.1, Dhaka. He is a current member of Parliament and a member of standing committee of Bangladesh Nationalist Party (BNP). The Website Exposing the Tribunals’ Clandestine activities
EXECUTIVE SUMMARY:
Until 11 December, 2012 the International Crimes Tribunal-1, Dhaka was composed of Mr. Justice Md. Nizamul Huq (Nasim) as Chairman, with Mr. Justice Md. Jahangir Hossain and Mr. Justice Anwarul Hoque as Members. The International Crimes Tribunal-2, Dhaka on the other hand was composed of Mr. Justice A.T.M. Fazle Kabir as Chairman, with Mr. Justice Obaidul Hasan (Shaheen) and Judge Shahinur Islam as Members. On 11, December, Mr. Justice Md. Nizamul Huq resigned when his clandestine skype conversations with a third party were disclosed. Following the resignation, the Tribunals were swiftly reconstituted. Mr. Justice A.T.M. Fazle Kabir was brought in from Tribunal-2 to serve as Chairman of Tribunal-1. Mr. Justice Obaidul Hasan was promoted to the post of Chairman of Tribunal-2 and a new member was inducted into Tribunal-2. The skype conversations which led to Mr. Justice Md. Nizamul Huq’s resignation show the level of impropriety and manipulation of the trials by the Executive and even the Judiciary itself. Continue reading
73% supports Re-Trial & Statement of UK Bar Human Rights Committee calling for re-trial
The Daily Star on 15th December 2012, published results of an Online poll where 73% voted in favour of the demand of Bangladesh Bar Council, Supreme Court Bar Association & 6 Senior Advocates of Bangladesh to restart theTrials afresh at the International Crimes Tribunal in the light of the recent revelation of the misconduct of the presiding judge, illegality of the procedure & collusion with prosecution. The online poll (see attached) shows 73% support in favour of the jurists who opined that the gross misconduct & illegality in the Trial procedure have vitiated trials process hence must restart to prevent miscarriage of Justice. 26% voted against & 1% abstained from making comment.
On the other hand, after Human Rights Watch, the Bar Human Rights Committee of England and Wales (“BHRC”) who raised deep concerns on November 16th 2012 as to the fairness of proceedings before the Bangladesh International Crimes Tribunal (“ICT”), now urgently calls for there to be a retrial in the case of Delwar Hossein Sayedee. BANGLADESH suffered a violent birth. In the last days of 1971 the country then called East Pakistan was engulfed by torture, rape, mass-killing and other acts of genocide. The main perpetrators were Pakistani troops bent on preventing secession from “West Pakistan”. But the army had the support of many of East Pakistan’s fundamentalist groups, including Jamaat-e-Islami, which remains Bangladesh’s largest Islamic party.
